1st, Rights of Children and Young Persons


Hi Class,

Please read CAD (Anonat, 2009) pp 1-21 and answer the following:

1. Describe human rights in your own words.
2. Name at least two Rights of Children and Young Persons. Briefly describe ways on how you can protect such rights as an educator.
3. Read RA 9344, RA 7610, RA 7658, RA 8049, and RA 8353.  Why are these laws important?

  1. 1. Human Rights are privileges that each person is equally entitled to regardless of gender, race, religion or status.

    2. "Right to education" and "Right to freedom of thought" are two among the rights that every child should receive. As an educator, I can protect these rights by simply extending my knowledge to others especially the young ones. May it be formal (in class) or tutorial for those who have no means of going to a formal school. Also, I will give them the chance express their thoughts. It would boost their confidence and self-esteem which in the end would make them good leaders.

    3. RA 9344 - Juvenile Justice and Welfare Act. This act exempts children 18 years old and below from criminal liability.
    Importance: Children are prone to committing mistakes, sometimes, mistakes that are against the law and needed legal actions. This act serves as a guide on how to deal with a child committing a crime in such a way that their rights are still protected.

    RA 7610 - Special Protection of Children against Abuse, Exploitation and Discrimination Act
    Importance: This act protects and rehabilitates children who are abused. This will also serve as a reminder to parents or guardians of their responsibility and for them to be reminded that sanctions will be imposed if children are not treated well.

    RA 7658 – An Act Prohibiting the Employment of Children below 15 Years of Age
    Importance: It is prohibited to hire children less than 15 years of age where he/she should be studying. An adult find it difficult to cope a stressful working environment, what more a child. Also, employers may tend to abuse them in terms of salary due to their ignorance of the labor system.

    RA 8049 – An Act Regulating Hazing and Other Forms of Initiation Rites in Fraternities, Sororities, and Other Organizations and Providing Penalties Therefore
    Importance: Hazing is prohibited because it encourages violence and for the past years, there have been reported deaths due to hazing. This I think is the primary reason why this act is created and penalties have been set so that those fraternities, sororities, etc. will be reminded of the repercussions once they violate this law.

    RA 8353 – Anti-Rape Law of 1997. It is an act expanding the definition of the crime of rape.
    Importance: Marital rape and Rape committed against men are some of the amendments in the Anti-Rape Law to name a few. Amendments in the Anti-Rape Law are important especially to the young ones wherein, for example, an act of lasciviousness (where a child is the common victim because they are easily threatened) can be considered a crime of rape. This would raise awareness to children so that they would know what to do in case they were abused.

  2. 1. Human rights are basic and fundamental rights that are granted to a person simply because he /she is born as a human being. These rights are recognized everywhere. These rights are created to give all human beings an equal chance to pursue whatever good there is that they want to pursue regardless of race, gender, color and disability.

    2. Rosa Anonat has pointed out five rights for children. These are: the Right to life, the right to a name and nationality, the right to protection from violence, the right to education, the right of freedom of thought.
    As an educator, I believe that I can protect these rights by simply doing what I love the most, teach. By reaching out to as much people as I can through education, I can make an impact in upholding the rights of children. I believe that education is the backbone of society and that through it, people can deliver genuine change.

    These laws are important especially in the present time because they protect the youth in many ways. Children are usually prone to abuse and danger because of they are innocent, powerless, and physically weaker than adults. Most of them are clueless on right and wrong. These laws tailored fit to help even young children by extending certain factors of the law in order to protect them.

  3. 1. Human rights are rights essential to all human beings and with that we are all equally entitled to our human rights without discrimination.

    2. RIGHT TO EDUCATION and RIGHT TO FREEDOM OF THOUGHT. To protect these two rights as an educator, I should exert more effort in collecting new ideas and information for me to impart these knowledge with my students, for them to be able to use these data in their future use. Because having vast knowledge is also a form of means that the students have attain these rights.

    RA 9344 – the Act Establishing a Comprehensive Juvenile Justice and Welfare System

    - This deals with the children who commits crime below 18 years of age and how to deal with them without affecting their rights.

    RA 7610 - Special Protection of Children against Abuse

    - This act guides the making of a comprehensive program for the safety of children against any kind of abuses.

    RA 7658 – An Act Prohibiting the Employment of Children below 15 Years of Age

    - It deals with the hiring of children as a part of the labor force in any kind of establishment and in any form.

    RA 8049 – An Act Regulating Hazing and Other Forms of Initiation Rites in Fraternities, Sororities, and Other Organizations and Providing Penalties Therefore

    - This act stated that no hazing or initiation rites in any form or manner by a fraternity, sorority or organization shall be allowed without prior written notice to the school authorities. This law has been made to stop the promotion of violence among youths.

    RA 8353 – Anti-Rape Law of 1997

    -This deals with the persons committed an act of lasciviousness. This law protects the victim of rape especially those who are still in the age of minority.

  4. Describe human rights in your own words.

    => Human rights are the same for all human beings regardless of race, sex, religion, political, national or social origin. We are all born free and equal in dignity and rights also human rights for me cannot be taken away; no one has the right to deprive another person.

    Name at least two Rights of Children and Young Persons. Briefly describe ways on how you can protect such rights as an educator.

    => First is the Right to Education, as an educator the best way to protect this right is to accommodate all children who wants to study and be enrolled in a school, no matter what state they're in we should entertain them.

    => Second is the Freedom of Thought, as an educator the best way for me to protect this right is to allow every child to think and voice out their opinions.

    Read RA 9344, RA 7610, RA 7658, RA 8049, and RA 8353. Why are these laws important?

    => RA 9344 - the importance of this law is it gives a child (below 18 yrs old) who committed a criminal act to be change instead of locking them up behind the bars.
    => RA 7610 - the importance of this law is it provides children protection against those people who abuse them.
    => RA 7658 - the importance of this law is it prohibits children to be workers in such young age, because children should be educated first inside the school.
    => RA 8049 - the importance of this law is it protect children away from Fraternities or Sororities that initiates hazing and this is really for their own sake due to hazing may cause death if not executed properly.
    => RA 8353 - the importance of this law is it protect children against people who might abuse them sexually with the help of NGO's and DSWD children will be given the right protection they need.

    Human rights, are for all of us. equal and without discrimination. It is a freedom of individuals or group. to advocate human rights is to demand that the human dignity of all people be respected.

    2.Right to education promote and develop the right of every person to access the good quality of education without discrimination. As an educator my responsibility is to give wealth information/knowledge to students as well as to understand the issue.because education is a powerful tool to lift on poverty economically and socially to participate as fully citizens. Right to health and the right to life is the child’s right to sustained and equal access to comprehensive treatment and affordable medicines. also educate the parents and their children as to guarantee them a better quality of life, proper nutrition of child's growth and development.children must give consideration to the best interest in decision making.

  6. 1. Human rights are indispensable to all human beings, rich and poor, strong and weak, male and female, of all races and religions for us to live on the earth as a "real" human. There are many cases shown in the news that how important human rights are. For instance, some parents maltreat their children physically merely because of thinking they are their guardians so they can do anything on them. However. human rights come first before parental authority. Thus, I describe human rights as the utmost right which should be observed prior to anything.

    2. Right to education and Right to freedom of thought. To protect these two rights as an educator, I must exert my endeavor into specializing in my field of study, so that I will be able to instruct my students with confidence and perfection. Moreover, I should be careful with being biased on one perspective, otherwise it will plant another one-sided thought in minds of my future students.

    Republic Act NO. 9344, 7610, 8049, and 8353 aims at protection of the growth and development of the adolescent. If RA 9344, 7610, 7658 does not exist, children will spend the rest of their live in jail without any chances given to start new lives and harshly abused in sexual and laborious ways under no protection of the law.

    From the words themselves, Human Rights are rights of human beings. People are entitled to these rights because they are part of the society who establishes these rights.

    2. Name at least two Rights of Children and Young Persons. Briefly describe ways on how you can protect such rights as an educator.
    Two of the rights of children are Survival Rights and Development Rights. As an educator, we have to make sure that our students are well-informed about the value of life. We have to teach them the right from wrong; thus, we have to tell them that taking one’s life is wrong. Since our students will later on be parents, we have to teach them as early as now the value of life. We have to tell them that this is the most beautiful gift given to us by God. Hence, this will eradicate eventually abortion among young girls who get pregnant early. Educating them early is the best way to eliminate the root of this problem. Children have also the right to education. We have to make sure as an educator that children will learn. They have to get the most out of going to school. We have to make sure that only quality education will be given to them. Since they are the future of our country, we have to update and upgrade ourselves as educators to make sure that they are indeed learning from us. Moreover, we have to actively participate in clamouring for a higher budget for education. We have to voice out our sentiments to the government to help the children have a quality education through improving the facilities and supplementing enough books for students. As an educator, I believe that it is only through education that we can progress as nation.

    3. Read RA 9344, RA 7610, RA 7658, RA 8049, and RA 8353. Why are these laws important?
    These laws are important because they protect the children from the maltreatments and abuses of some people. For instance, RA 9344 is an act establishing a comprehensive juvenile justice and welfare system, creating the juvenile justice and welfare council under the department of justice; RA 7610 is an act providing for stronger deterrence and special protection against child abuse, exploitation and discrimination; RA 7658 is an act prohibiting the employment of children below 15 years of age in public and private undertakings; RA 8049 is an act regulating hazing and other forms of initiation rites in fraternities, sororities, and other organizations; and RA 8353 is an act expanding the definition of the crime of rape, and reclassifying the same as a crime against persons. Therefore, with the establishment of these laws, we are guaranteed that children and young people are protected and will be defended by the law.

  8. 1. Human rights are the rights given by the state to every human being within its territory. Meaning no one should be deprived of life nor liberty whether you are a foreigner or a local. In law the meaning of life is not just life per se it also encompasses the ability to enjoy life. So, if you remove someones eye, finger, ear that would be a clear violation of that persons right to life.

    2. Some of the rights of children and young person are right to a name and a nationality and right to protection from all forms of violence. As an educator I will protect such rights by educating not my students but also their parents and the members of the community about these rights and the consequences of it if it is not obeyed specially if I am going to be assigned in rural areas. By simply educating them that they need to register their newly born babies would mean a lot. In terms of violence I will urge my students not to tolerate and stand against any forms of it whether inside or outside the classroom. I will sow in their minds that I am not just their teacher but also a friend, brother, and a father who is always there to protect them.

    3. The above mentioned laws are important because those laws are created so that every minor age person could enjoy their lives and exercise their rights. If any of those laws has been violated a minors life is already in jeopardy. The wounds will heal but the scars(hatred, anger, fear) will remain.

  9. 1. Describe human rights in your own words.

    Human rights - are the rights of everyone to live as human beings. It enables us to use our human qualities, intelligence,our talents, and our own spirituality to develop our full potential as a person. It does not discriminate anyone regardless of his nationality, gender, the color of skin,age, status in life educational attainment and religious beliefs to be protected and ensure to receive equal treatment if subjected to abuses and violations.

    2. Name at least 2 Rights of Children and Young Persons. Briefly describe your ways on how can you protect such rights as an educator?


    a. Right to Education- All children need to be educated in order that they could have bright futures. If they are knowledgeable, they could have better chances in finding well-paying jobs. That could support the various needs of their families and be financially stable. If plenty have jobs, our economy will prosper and all could have better lives.
    As an educator, I could help my pupils by being aware of their needs. I could do home-visit to know the problems of children having difficulty in school. We could have a dialogue or counseling to resolve the poor performance of the students.

    b. Right to life - Every child should have a decent home, clothes to wear, eating good and nutritious food and his/her medical needs are provided when he/she gets sick.
    I know that to go to school on an empty stomach results in poor performance in class activities. Conducting feeding programs can help to give them nourishment. If their health and safety are threaten by floods, finding help through donations from government, business establishment, philantropic people or even parents of students, can be a solution to address the problem.

    3. The Importance of these laws for children ?

    Because children are vulnerable they are subject to abuse. The said laws protects them. Our children deserves to have a better lives. Children does not need to go to work and do hard labor. Being children they need to be in school and enjoy being a child. However if children and young person are caught doing crimes, they should be subjected to punishment according to their age. They must receive counseling and be given a chance to learn skills for them to be productive after they leave the premises.
    Children subjected to sexual abuse, prostitution or child trafficking must be treated carefully and with great compassion and understanding. They may have traumas afterwards. Counseling is a must, to develop again their self-respect, self-worth, and belief in human beings again.
    We heard plenty of victims of hazing that have not been given justice. Plenty of those who perform the rites had not been caught. Justice are not yet given to all of them. The schools should ban this practice so that lives must not be put in danger. Stricter implementation of the law must be practice.
    The anti-rape law was really necessary for the protection and welfare of those abuse. What they go through take away their self-respect,belief on the goodness of human beings and even in some point, belief in the love of God. A thorough counseling and rehabilitation must be done for them to be able to surpass what they experience and be able to live their lives again.

  10. 1. Human Rights refer to universal fundamental rights to which a person is inherently entitled. These rights maybe natural, legal, social, or ethical principles of freedom or entitlement. Rights are considered as essential to civilization, being regarded as established pillars of society and culture.

    2. Developmental Rights. This refers to the right of young persons to education. As an educator, we have an obligation to our society to educate young persons regardless of their gender, ethnicity, and economic status in life. Participation Rights. This refers to the right of young persons to express themselves. As an educator, we must listen to the thoughts and expressions of young persons, for even though they are still immature persons lacking experience in life, they still have the right to be heard.

    3. These Republic Acts are important for they ensure that the natural, legal, social, and moral rights of the children and young persons in our country are observed and protected by our national government.

    Human Rights are the inherited right or a privilege given to an individual regardless of ethnic origin, gender, age and religion under constitutional approach.

    2. Name at least two Rights of Children and Young Persons. Briefly describe ways on how you can protect such rights as an educator.
    Here are some rights of the children:
    1) Right to education: Educators can protect it by empowering the parents of the ongoing free education support or scholarship of the private and local sectors. Another as a means of financial support, we may refer them to livelihood programs or seminars because nowadays poverty is one of the hindrances in sending children to school.
    2) Right to protection: Educators may protect the students in talking with parents with regards of practice of corporal punishment and its effect in the student. Another about sexually abuse student, educators can help to protect their student/s in talking with parents together with school administration and local government such as DSWD.

    3. Read RA 9344, RA 7610, RA 7658, RA 8049, and RA 8353. Why are these laws important?
    1) RA 9344 - "Juvenile Justice and Welfare Act of 2006."The law aims to protect the welfare of children in conflict with the law, majority of who are guilty of minor crimes such as petty theft, vagrancy and sniffing glue. It’s important to give a chance to children especially those had committed crime at young age not be in prison but to reflect and to have proper guidance to start a new.
    2) RA 7610 - "Special Protection of Children Against Abuse, Exploitation and Discrimination Act.” An act providing for stronger deterrence and special protection against child abuse, exploitation and discrimination and for other purpose. It is important to protect the child for abuse such as sexually, being bullied and racial discrimination that may affect child’s growth and development.
    3) RA 7658 – An act prohibiting the employment of children below 15 years of age in public and private undertakings. It is a protection against child labor.
    4) RA 8049 – “Anti – Hazing Law.” An Act Regulating Hazing and Other Forms of Initiations Rites in Fraternities, Sororities and Organizations and Providing Penalties. It helps to protect the child from forceful induction in joining an organization.
    5) RA 8353 – “Anti-Rape Law”. An act expanding the definition of the crime of rape, reclassifying the same as a crime against persons. It will help to stop trading child as sexual abuse.

    1. Human rights, as a personal description, is one what really matters most which makes us human. Under human rights are such acts that will regard an individual as humans and this ensures equality regardless of race, color or religion and preserves his/her self-respect, integrity, honor. Human rights do not hinder one's eagerness to self-improvement but might as well be an instrument for the personal and professional growth

    2. Right to protection from all forms of violence including, sexual exploitation

    Explanation: Currently, the Department of Education shares this vision of every educators and learning institutes to eradicate all forms of violence such as bullying, cyber bullying, sexual exploitation and such, that compromises young people's mentality and innocence. This is a very fortunate situation to all concerned: educators, parents/guardians and learners as well to work hand in hand to create a safe and secure learning environment that will someday enhance the learners' full potentials.

    Explanation: I personally think that these two could interrelate with one another. It as important for the learners to have an authentic understanding from the knowledge that they acquire from education. Educators must keep in mind that we must be an inspiration for these students to express their concerns, critiques and personal opinions to the topics captured them the most. One should protect this by continuing to enhance this kind of teaching strategy

    Explanation: I realized that these laws possibly that they have one objective, protecting children from all sorts of violence. It could be situations very stressful to them that may elicit fear, anger, insecurities and some destructive emotions that could hinder their learning and effect the mental stability. I conclusion, these laws significantly work hand in hand to make sure every child live in a safe and comfortable environment for their optimal development.

    1. Describe human rights in your own words

    Human rights are rights inherent to all human beings whatever the nationality, color, ethnic, religion, language, status, etc. Meaning, all people are equally entitled to human rights without discrimination. These human rights are all interdependent and interrelated.

    2. Name at least two rights of children and young persons. Briefly describe ways on how you can protect such right as an educator.
    Right to Protection from All Forms of Violence, including Sexual Exploitation
    As an educator, I can protect this right by inculcating good moral values to children and young adults., I will explain and give emphasis on the importance of their right not to be involved in activities or organizations that will cause physical, psychological nor emotional harm to them like hazing (in fraternities).I will advocate the anti bullying and cyber bullying act in the school and will encourage students to do the same thing.
    Right to Education
    This is one of the important human rights every child should experience. Whether a person comes from an indigent family or from an ethnic group, children are entitled to have a decent education in order to be productive citizen of the country.

    Almost half of the country’s population is composed of children aged 17 and below. This age group is considered vulnerable group and minors. They are unaware of their rights and unable to protect themselves. Because of this, the government has a major responsibility of protecting the rights of the children. Hence, the promulgation of these Republic Acts by the government, are guided by Section 13 Article I of the Philippine Constitution which embodies the promotion and protection of the children’s physical, moral, spiritual, intellectual and social being.
